The e-shop is the online store for the distribution of products through the Internet created by the company with the distinctive title “AERAKI” based in Rethymnon, with TIN. 143651985 (hereinafter referred to as “AERAKI”). The use of the e-shop is governed by these terms and conditions (hereinafter Terms), which users are required to read carefully and comply with them. AERAKI considers that the users before visiting the e-shop have been informed of the Terms, as they are valid each time and have accepted them unconditionally. The use of the e-shop implies unconditional acceptance of these Terms and Conditions. If a user does not agree with these terms and conditions, then they must not use the e-shop.
AERAKI reserves the right to modify these Terms and Conditions of Use at any time without notice, but undertakes to update this text for any modification or addition. Any invalidity of some Terms hereof does not result in the invalidity of the others. The non-exercise by AERAKI of its rights under these Terms does not imply a waiver of those rights. AERAKI is not responsible for violation of these Terms due to reasons of force majeure, such as extreme weather events, earthquakes, floods, fires, emergencies, etc.
In case the sale of any product of the e-shop is regulated by more specific terms of use, these terms are considered as a whole with these Terms of Use. However, in case of conflict, the specific terms of use of each product or service prevail. Any dispute arising from the use of the present services between the user and the store is subject to Greek law and is resolved by the courts of Rethymnon.
2.Information – Products
AERAKI is committed to the quality, completeness and validity of the information provided on the site, both in terms of the identity of the e-shop and the services provided by it. The user is informed about the availability of the products through appropriate verbal indications. Also, the various product offers that appear in the online store, are always valid until stocks run out.
3.Order
The conclusion of a valid order is possible if the user is legally competent according to the Greek Civil Code, namely if they have completed the 18th year of age and are not under legal support regarding the conclusion of a sales contract. During the placement of an order the visitor / user declares that their data is accurate and true and accepts that AERAKI, in case it finds that the real data have not been declared and provided that this data is essential for the correct completion of the order, can cancel their order.
The completion of the order is done after the unconditional acceptance of these Terms of Use and the Final Submission of the order. Up to the point of final submission, the user can cancel their pending order at any time. After the Final Submission, the order is canceled by the user in consultation with the store, either by phone or by sending an e-mail to info@aerakiofficial.com , with reference to the “Order Cancellation” and its code, provided the order has not yet been shipped. In case the order has already been sent, the user will be charged with any costs of returned goods and shipping costs.
Having sent the order form, the user receives a copy of the order, which can be saved and / or printed, including:
The full name and address of the store.
The main features of the product.
The price, quantity and cost of transport, as well as value added tax (if not included in the price).
Method of payment, delivery and execution. The period of validity of the offer or price;
The right of withdrawal, in particular, the terms and details of this right, as well as a sample declaration of withdrawal in a special form;
Information on after-sales service and any existing warranties.
The order code, allowing the user to track the progress of his order.

This method is recommended when ordering for a custom item, which involves either modifying or manufacturing a specific product from the store (e.g. pareos or modifying colours to a specific pareo).
In response to your message, we will contact you personally, by any appropriate means, in order to achieve the best and fastest possible service.
The user is solely responsible for the e-mail address which they declare to be their personal, true and under their complete and exclusive control, of AERAKI not liable for any damage to the visitor / user by any third party access to their e-mail.
AERAKI reserves the right to ask the visitor / user for further supporting documents to confirm that they are the legal holder of the e-mail address declared by them or have permission to use it from its rightful owner. In case the visitor / user refuses to send the required documents or AERAKI finds that the user is not the legal owner of the email address, AERAKI reserves the right to delete them.
4. Users are responsible for all transactions carried out with their personal data and are obliged to immediately notify AERAKI of any unauthorized use that may be made with them and of any (even possible) breach of security. These details are not disclosed by AERAKI to third parties.
AERAKI is not liable for any damage or loss that may arise for users from the arbitrary or illegal use of their data by third parties, due to their leakage or for any other reason and reserves the right to claim compensation from the user, in case of any kind of damage from the arbitrary or illegal use of their data. AERAKI is entitled at any time to terminate the provision of these services to the user and to refuse any current or future use of the e-shop, in case of violation of the Terms of Use.
5. User Responsibility
Users accept, agree and stipulate that they will make legal and appropriate use of the e-shop. Therefore, the users indicatively and not restrictively agree that they will not use the online store of AERAKI for:
1. sending, publishing, sending by e-mail or transmitting in any other way any content that is contrary to the law as well as good and commercial morals, in any way violates the privacy and individual and social rights of third parties, is illegal, harmful, threatening, offensive, disturbing, defamatory, slanderous, vulgar, obscene, libelous, is a violation of someone else’s privacy, shows empathy, or expresses racial, ethnic or other discrimination,
2. causing harm to minors in any way,
3. posting, publishing, sending by email or otherwise transmitting any Content for which users do not have the right to transmit in accordance with the law or contractual or managerial relationships (such as inside information, ownership and confidential information obtained or disclosed as part of an employment relationship or covered by confidentiality agreements),
4. posting, publishing, sending by e-mail or otherwise transmitting any Content which infringes any patent, trademark, trade secret, copyright or other proprietary rights of others;
5. to deceive anyone as to the origin of the content of the e-shop, to damage in any way the reputation of AERAKI or third parties, to endanger the internet security of AERAKI, to prevent any user to access the e- shop,
6. install and promote, in any way, any kind of unsolicited or unauthorized advertising or unsolicited spam, chain mail, pyramid schemes and any other form of spam;
7. sending, publishing, sending by email or otherwise transmitting any material containing software viruses or any other code, files, or programs designed to interrupt, damage, destroy, or equip the operation of any computer software or hardware,
8. intentional or unintentional breach of applicable law or regulations;
9. harassment of third parties in any way,
10. collect or store personal data about other users. In any case of use, illegal or contrary to these Terms, users are obliged to compensate AERAKI for any positive and negative damage.
6. Right to return / replace products.
In case of a real defect or lack of agreed quality, the buyer is entitled alternatively without charge of a) repair of the product or b) replacement or c) reduction of the price in proportion to the defect or d) withdrawal from the sale.
The user has the right to demand free of charge the fixing or replacement of the product if the order is executed incorrectly, i.e. another item other than the order is delivered or the wrong quantity or defective product or damaged packaging.
The user must contact the store within 48 hours of receiving the product at +306989952161 or email to the email address info@aerakiofficial.com, in order to point out the problem and approve their return.
If it is a product that does not correspond to the order, it must not have been used and must be in its packaging in the condition in which it was received.
In any case, the product must be returned with all the original accompanying documents (purchase receipt, warranty, instructions for use) and in its original packaging.
Returns are made with the postal company that we will suggest to you for our customers and at the expense of the store.
7. Right of withdrawal
The user has the right to withdraw from the agreement without specifying a reason to do so, within fourteen (14) calendar days, if no deadline has been agreed, returning the product to its original condition, without any charge of the user, excluding shipping costs. This deadline starts from the receipt of the products. In case the user exercises the right of withdrawal, AERAKI is obliged to return the money paid by the user within thirty (30) calendar days.
The exercise of the right of withdrawal by the user is possible only on condition that:
I. Refers to a product for which an individual order was NOT placed, e.g. pareos.
II. The user completes and sends the relevant withdrawal form provided when placing the order.
III. The product has not been worn or used except for testing, no parts have been removed and no changes have been made to the clothing item.
IV. “AERAKI” store labels and product labels have not been removed or damaged in any way.
V. All product accompanying documents, including warranty, instructions for use and proof of purchase, have been returned.
VI. The product has been shipped in its original package as received.
VII. An email has been sent to the following address: info@aerakiofficial.com, stating the return and order code.
The “AERAKI” store is not responsible for any loss or damage of the returned goods during transport.
In case the products are returned damaged or defective, then the store “AERAKI” will have the right to claim compensation from the user, the amount of which will be determined by the condition of the products and will proceed unilaterally to partially offset the claim against user.

8.2 Taxes
Taxes are already included in the price, but we are not responsible for any action taken by customs or the selected country outside the EU. In case of invoice for European company, we will deduct VAT 24% from your purchase price, if you include the VAT number in your order
8.3 Incorrect Product Price
AERAKI is not responsible for any technical, typographical or spelling errors in the prices or product characteristics. If a product has an unusually low price, without any specific evidence to justify this, please contact us before ordering this product. In any case, AERAKI withholds the right to not accept or cancel an order if there is an error concerning the price of the product.
9. Limitation of liability
AERAKI is not liable to customers / users for damages that may arise from the execution or not of their order. It is also reserved as to the time of delivery of the goods in cases of force majeure.
The e-shop can provide no guarantee for the availability of the products, but guarantees the timely information of the final consumers about their non-availability.
The e-shop provides the Content (e.g. information, names, photos) and the products available through the website “exactly as they are”. In no case is the online store of AERAKI liable for any claims of legal or civil and / or criminal nature or for any damage (positive, special or deposit, which indicatively and not restrictively, divisively and / or cumulatively consists in loss of profits, data, loss of earnings, monetary satisfaction, etc.) by visitors of the website or third parties due to a reason related to the operation or not and / or use of the website and / or inability to provide services and / or information available from it and / or any unauthorized interference by third parties with products and / or services and / or information available through them.
The e-shop, among other things, provides links to third party websites, which (third parties: web providers) have full (civil and criminal) responsibility for the security, legality and validity of the content of their websites and services, excluding any liability of AERAKI, such as indicative liability for intellectual and industrial property rights or any third party rights. Therefore, users are required to contact third parties directly (web providers) for anything that arises from their visit and / or use. Although users acknowledge that AERAKI is neither obligated nor able to control the security and content of the websites and services of third parties to which it provides access, it is at any time entitled to remove, modify or discontinue any third party service or link to third party websites, if, in its sole discretion, the law or these Terms are threatened or violated.
10. Intellectual property rights
The e-shop is the official online store of AERAKI. All its contents including images, graphics, photographs, drawings, texts, and products are the intellectual property of AERAKI and are protected under the relevant provisions of Greek law, European law and international conventions.
It is prohibited to copy, distribution, transfer, processing, resale, creating productive work or misleading the public, about the actual Content Provider of the Website. Reproduction, republishing, uploading, announcement, dissemination or transmission or any other use of the Content in any way or means for commercial or other purposes is permitted only with the prior written permission of the e-shop or any other copyright holder. The names, images, logos and insignia representing the e-shop or third parties and their products or services are the exclusive trademark of the e-shop or third parties protected by the relevant trademark laws. Their appearance on the website should in no way be construed as a transfer or assignment of their license or right of use.
11. Network availability
AERAKI makes reasonable efforts for the maintenance and availability of the e-shop. Users nevertheless accept that AERAKI has the right to modify and / or temporarily or permanently suspend all or part of it with and / or without notice to users, as availability may be affected by users’ equipment, other communication networks, the large number of people trying to use the e-shop at the same time or for other reasons. Therefore, AERAKI does not bear any responsibility for any kind of damage (positive, deposit, negligent, intra-contractual or other,) resulting from the inability of users to access it, the cessation of all or part of it, the delay, non-delivery, interruption or poor quality of receiving its services or loss of their content, the existence of any kind of errors. In any case, AERAKI reserves the right at any time to temporarily or permanently suspend the operation of all or part of the e-shop for maintenance or upgrade reasons or for any reason.
AERAKI makes every effort to protect the e-shop from digital viruses, it cannot guarantee that it will never be infected by viruses (virus free). Therefore, each user must take care of their own protection (use of antivirus, virus scanner or other protection systems) before using the e-shop or storing its information, software or content on his PC.
12. Applicable law and other terms
The above terms and conditions of use of the website “AERAKI”, as well as any modification, change or alteration are governed by and supplemented by Greek law, European Union law and relevant international treaties.
Any provision of the above terms becomes contrary to law, automatically ceases to be valid and is removed from the present, without in any case affecting the validity of the other terms.
This constitutes the entire agreement between “AERAKI” and the visitor / user of its pages and services and binds only them. No modification of these terms will be considered and will not form part of this agreement unless it has been formulated in writing and incorporated into it.
